1. Introduction
1.1. The Service is operated by Proofly ("Company", "we", "us", "our"), a company registered in the United Arab Emirates with company number 10248, and registered office at 3rd Floor, A3 Building, Business Center, PO Box 449648, Dubai, United Arab Emirates.
1.2. These Terms of Use ("Terms") constitute a legally binding agreement between you and the Company regarding your access to and use of the Proofly website (www.proofly.ai) and related services (collectively, the "Service").
1.3. By using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Changes to Terms
2.1. We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or through other communication channels.
2.2. Your continued use of the Service after the changes constitutes your acceptance of the modified Terms. If you do not agree with the new Terms, you must stop using the Service.

6.1. The Service allows you to upload, transmit, store, or otherwise make available content, which may include photos and videos ("User Content").
6.2. You retain full ownership and responsibility for your User Content. You grant us a non-exclusive, worldwide, royalty-free license to use, copy, and process your User Content for the purpose of providing the Service (i.e., detecting deepfakes).
6.3. You represent and warrant that: (a) you have all necessary rights to grant us the license described above; (b) your User Content does not violate these Terms or any applicable law.
6.4. We have no obligation to screen, monitor, review, or edit any User Content. However, we reserve the right to remove any User Content at any time without notice, including if the Content violates these Terms.
6.5. We do not claim ownership of your User Content and are not responsible for any User Content posted by you or others. You are solely responsible for your User Content and the consequences of posting or publishing it.
7. Service Description
Proofly is an online service that uses AI technology to detect deepfakes in photos and videos. Users can upload their content or provide a link to the content for analysis.
8. Intellectual Property
8.1. The Service and all associated intellectual property rights are owned by us, our licensors and/or affiliates. We reserve all rights not expressly granted in these Terms.
8.2. The trademarks, service marks, designs, and logos of the Company displayed as part of the Service are registered and unregistered marks of the Company.
8.3. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal use.
8.4. You may not use our trademarks or other brand elements without our prior written permission.

9. Disclaimer of Warranties
THE SERVICE AND ALL MATERIALS, INFORMATION, SOFTWARE, PRODUCTS AND OTHER CONTENT PROVIDED ON OR THROUGH THE SERVICE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES, REPRESENTATIONS OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS OR RELIABILITY OF ANY INFORMATION ON OR PROVIDED THROUGH THE SERVICE.
10. Limitation of Liability
IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, MEMBERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION BASED UPON CONTRACT, NEGLIGENCE, TORT (INCLUDING WITHOUT LIMITATION STRICT LIABILITY), OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SERVICE OR MATERIALS PROVIDED THEREIN.
